Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, products, and cloud infrastructure services provided by Onewehost Cloud LLC (“Onewehost”, “we”, “us”, or “our”). By creating an account, placing an order, or using our cloud hosting and related services (the “Services”), you agree to be bound by these Terms and all policies referenced here (including our Privacy Policy, Terms Of Services, Refund Policy, and Data Processing Addendum (DPA)).

If you do not agree to these Terms, do not use the Services.

1) Definitions

  • Account: your Onewehost customer account.
  • Customer Content: data, code, files, websites, apps, or materials you upload, deploy, transmit, or store using the Services.
  • Order: a purchase, subscription, or provisioning action you place or accept (including via dashboard or API).
  • AUP: our Acceptable Use Policy, incorporated by reference.
  • DPA: our Data Processing Addendum governing processing of personal data in Customer Content.

2) Eligibility & Account

  • You must be at least 16 years old and capable of entering a binding contract.
  • Provide accurate registration, billing, and contact information and keep it up to date.
  • You are responsible for all activity under your Account, safeguarding credentials, and promptly notifying us of any unauthorized use.
  • We may require identity or company verification (KYC/AML, sanctions screening) and may suspend or refuse Service where verification fails or risk is unacceptable.

3) Customer Content & Ownership

You retain ownership of Customer Content. You grant Onewehost a non-exclusive, worldwide license to host, reproduce, and process Customer Content solely to provide and support the Services and to comply with law and these Terms.

You are solely responsible for Customer Content, including its legality, accuracy, and compliance with intellectual property and privacy laws. For personal data in Customer Content, you are the data controller and we are your processor as described in the DPA.

4) Acceptable Use

You will not use the Services to, or allow others to:

  • Violate law or third-party rights, including IP, privacy, or data protection laws.
  • Engage in abuse or security violations: malware, ransomware, phishing, botnets, command-and-control, mass port scanning, credential stuffing, brute force, or unauthorized access.
  • Transmit spam or unsolicited communications; run open relays; host phishing or deceptive sites.
  • Host, share, or facilitate CSAM or exploitative content.
  • Conduct DDoS attacks or generate traffic that intentionally degrades networks or other customers; or use the Services as DDoS reflectors/amplifiers.
  • Infringe export/sanctions controls; use the Services in, from, or for embargoed countries or prohibited parties.
  • Use the Services for high-risk activities (e.g., life support, critical infrastructure) where failure could cause death, personal injury, or severe environmental damage.
  • Engage in cryptocurrency mining or crypto-asset validation (including but not limited to Proof-of-Work or Proof-of-Stake mining, mining pools, or similar workloads) on any of the Services.

5) Resource Usage, Fair Use & Network

  • Configure applications responsibly and comply with plan limits (CPU, RAM, storage, bandwidth, IOPS, egress, API rate limits).
  • We may apply fair-use protections or rate limiting to maintain stability and protect other customers and upstream providers.
  • We may migrate, isolate, or suspend workloads causing instability, security incidents, or disproportionate resource consumption.
  • IP addresses are licensed and may change; misuse (spam/abuse listings) may result in removal or fees.

6) Security & Backups

  • We maintain reasonable technical and organizational measures (e.g., encryption in transit, access controls, monitoring).
  • You are responsible for securing your applications, accounts, SSH keys/API tokens, content, and configurations.
  • Backups (if included) run on a best-effort basis and are not guaranteed. Maintain your own off-platform backups.
  • Report security issues to contact@onewehost.com. We may request temporary access to reproduce or resolve issues.

7) Orders, Billing & Payments

  • Prices, billing cycles, and plan details are shown at checkout and/or the dashboard. All prices are displayed in USD (unless otherwise stated) and taxes/fees may apply.
  • We accept card payments via Stripe and cryptocurrency via a crypto processor. Card data is processed by Stripe (PCI-DSS compliant); we do not store full card numbers or CVV.
  • Statement descriptor: your card statement may display “ONEWEHOST* CLOUD” or a substantially similar descriptor.
  • Subscriptions auto-renew until cancelled. You authorize recurring charges to your payment method for each term.
  • Trials & introductory offers: for any free trial or promotional pricing, we will send an email reminder 3–7 days before the first paid charge with clear cancellation instructions.
  • Cancellation: you can cancel at any time in the dashboard at /billing (Stripe Customer Portal) or by contacting support. Cancellation stops future renewals; fees already incurred remain due.
  • Disputes/chargebacks: you may dispute a charge with your bank. We do not impose any fee or penalty for opening a dispute. Access may be limited only for unpaid amounts after resolution.
  • If a payment fails, we may retry, request an alternative method, and suspend/terminate for non-payment after notice.

Refunds (if any) are governed by our Refund Policy. Promotions and trials are subject to stated terms and anti-abuse checks.

8) Privacy & Data Processing

Our Privacy Policy explains how we collect and use personal information. For personal data in Customer Content, the DPA applies (controller: you; processor: Onewehost). You must obtain consents and provide notices required by law.

9) Third-Party Services

The Services may integrate third-party services (e.g., domain registrars, SSL providers, package repositories). Your use of third-party services is subject to their terms and privacy policies. We do not control third-party availability or security.

10) Intellectual Property

The Services, websites, software, documentation, and Onewehost marks are owned by Onewehost and its licensors, protected by IP laws. No rights are granted except as expressly stated in these Terms. You may provide feedback; you grant us a worldwide, royalty-free, perpetual license to use feedback to improve the Services.

11) Copyright Complaints (DMCA)

If you believe content hosted on our infrastructure infringes copyright, send a notice to our DMCA Agent:

Include: your contact details; identification of the copyrighted work; the infringing material and its location; a statement of good-faith belief; and a statement under penalty of perjury that you are authorized to act. We may remove or disable access to alleged infringing content and, where appropriate, terminate repeat infringers.

12) Suspension & Termination

  • We may suspend or terminate Services immediately for AUP violations, security incidents, legal requests, non-payment, or risk of harm.
  • You may cancel at any time via the dashboard; fees already incurred remain due. Upon termination, access ends and data may be deleted per our retention/backup schedules.
  • We may preserve data or logs as required by law, investigations, or to enforce our rights.

13) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT SECURITY MEASURES WILL PREVENT ALL ATTACKS OR BREACHES.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONEWEHOST WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO ONEWEHOST FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THAT PERIOD.

15) Indemnification

You will defend, indemnify, and hold harmless Onewehost, its affiliates, and their officers, directors, and employees from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from or relating to Customer Content, your use of the Services, or your breach of these Terms or the AUP.

16) Export, Sanctions & Compliance

You represent and warrant that you are not subject to trade sanctions or designated on any restricted-party list, and you will not use the Services in, from, or for jurisdictions or parties prohibited by applicable export control and sanctions laws.

17) Force Majeure

We will not be liable for delays or failures caused by events beyond our reasonable control, including acts of God, natural disasters, labor disputes, war, terrorism, civil disturbance, internet or power outages, or failures of third-party providers.

18) Changes to Services & Pricing

We may modify the Services and pricing from time to time. Material adverse changes will be notified in advance when reasonable. Continued use after changes become effective constitutes acceptance.

19) Changes to These Terms

We may update these Terms. If changes are material, we will provide notice (e.g., email or dashboard). The “Effective date” above reflects the latest version. Your continued use after the effective date constitutes acceptance.

20) Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles, except that mandatory consumer protection laws of your country of habitual residence will prevail where required by law.

Except where prohibited by law, the parties submit to the exclusive jurisdiction of the state and federal courts located in Wilmington, Delaware, USA. If you are a consumer resident in the EEA/UK, you may bring a claim in your local courts and we may only bring actions in your country of residence. Nothing in this section limits your rights to alternative dispute resolution where available.

21) Miscellaneous

  • Entire Agreement: these Terms, the AUP, Privacy Policy, DPA, Refund Policy, and any Order constitute the entire agreement.
  • No Waiver: failure to enforce a provision is not a waiver.
  • Severability: if any provision is unenforceable, the remainder remains in effect.
  • Assignment: you may not assign without our consent; we may assign to an affiliate or in connection with a merger, acquisition, or sale of assets.
  • Notices: we may provide notices to your Account email or dashboard; you may send notices to contact@onewehost.com.
